AGREEMENT: By signing this agreement the above named Individual agrees to abide by the guidelines set for the position volunteering and to follow and abide by all policies set forth by the Fairgrounds COUNTY. In consideration for being allowed to volunteer at the Benton County Fairgrounds/Fair, the above named and below agreement to the terms and conditions of the Volunteer and Volunteer’s parents/guardians agree to abide by the following:
ACKNOWLEDGMENT OF RISK: The Volunteer and Volunteer’s parents/legal guardians understand, acknowledge and accept that fairgrounds and fairs are dangerous activities and that the participation in a fair or at a fairgrounds, including the Benton County Fairgrounds/Fair, either as a contestant, an employee or volunteer, exposes the Participant to a substantial and serious risk of property damage, personal injury and/or death.
RELEASE: The Volunteer and Volunteer’s parents/legal guardians, being fully aware that articipation on or at the Benton County Fairgrounds/Fair may expose him/her to a substantial and serious risk of property damage, personal injury and/or death, hereby waive, release and discharge Benton County, the Benton County Fair Board and their officers, agents and employees, from any and all liability for any and all property damage, personal injury and/or death or any and all other claims, whether known, foreseen and unforeseen, future or contingent, arising from the Volunteer’s participation at and/or in the Benton County Fairgrounds/Fair.
COVENANT NOT TO SUE: The Volunteer and Volunteer’s parents/legal guardians covenant the
Volunteer and Volunteer’s parents/legal guardians shall not now or at any time in the future, directly or indirectly, commence or prosecute any action, suit or other proceeding against Benton County, the Benton County Fair Board and their officers, agents and employees, concerning, arising out of, or related to the actions, causes of actions, claims and demands hereby waived, released and discharged.
ASSURANCES: The Volunteer and Volunteer’s parents/legal guardians assure, represent and warrant that they have full power, authority, capacity and right without limitation to execute, deliver and perform this Release on behalf of the Volunteer and all of the Volunteer’s parents and/or legal guardians.
NAME AND LIKENESS: The Volunteer and Volunteer’s parents/legal guardians hereby give the
Benton County Fairgrounds/Fair permission to use the Participant’s name and photographic likeness, in connection with his/her participation at the Benton County Fairgrounds/Fair, for advertising or any other lawful purpose.
CONSENT OF PARENTS/LEGAL GUARDIANS: We represent that we are all of the parents/legal guardians of the below named Volunteer, that we have read the above Release in full, fully understand
its terms and conditions, and hereby voluntarily execute and deliver this consent to his/her participation at the Benton County Fairgrounds/Fair. We further agree to be fully bound by the Release’s terms and conditions in both our individual capacities and in our capacities as the parents/legal guardians of the Volunteer. My participation as a volunteer, whether for this assignment or other volunteer tasks or event that I accept from Benton County, is voluntary and I neither have received nor expect to receive any compensation for my participation in it. I agree to read, listen to and follow all safety instructions and procedures presented in conjunction with this assignment and to use my best judgement based upon my physical and mental abilities at all times, and to immediately terminate participation in this assignment or any other volunteer assignment. I agree to undertake if activities become too strenuous, difficult, or hazardous for me. I am physically and mentally capable of participating in the Assignment described above without injuring myself in any manner.
